Certification Regarding Confidentiality

This application and all documents submitted as part of it are public documents, except that the portions labeled or identified as confidential, proprietary, or trade secret will be withheld from disclosure to the extent required by the California Public Records Act (Chapter 3.5 (commencing with Section 6250) of Division 7 of Title 1 of the Government Code), Section 40062 of the Public Resources Code, and Article 4 of Chapter 1 of Division 7 of Title 14 of the California Code of Regulations (commencing with Section 17041). (See also 14 CCR Section 17989.6(b), (f)(3).) While the Public Records Act specifically exempts trade secrets from disclosure, there is no categorical exemption for information that is claimed to be “confidential” or “proprietary” but does not qualify as a trade secret. Unless some other express exemption applies, such information may be withheld from disclosure only where the need for confidentiality clearly outweighs the public interest in disclosure (see Government Code section 6255). “Trade secret” is defined at section 3426.1 of the Civil Code.
IMPORTANT: This application asks whether certain uploads contain trade secrets. For those uploads, a “yes” response does not label or identify the uploaded document as confidential in its entirety; you must still label or identify the specific portions that you claim to be exempt from disclosure. This may be done directly within documents or through any other means that clearly communicate what is claimed to be exempt from disclosure. Only material expressly labeled or identified as “trade secret” (as opposed to merely “confidential” or “proprietary”) will be treated as such for purposes of Public Records Act request.
