Waste/Used Tire Manifest Program
The “California Uniform Waste and Used Tire Manifest” maintains accountability by requiring copies of each manifest or comprehensive trip log to be submitted to CalRecycle for monitoring tire movement within California.
The law also allows data to be submitted electronically to CalRecycle (see electronic data transfer for more information). In addition, regulations have been developed to provide guidance and procedures in meeting manifest system requirements.
The program applies to all persons, businesses, nonprofits, and government agencies generating, transporting, or receiving waste or used tires.
- Program Participants. Information to help generators, haulers, and end-use facilities determine their role in, and requirements for, the waste tire manifest program.
- Search Registered Haulers. Anyone who transports 10 or more waste or used tires at any given time on a public road must be registered.
- Tire Program ID (TPID). All participants need a TPID to complete the required forms.
- Comprehensive Trip Log (CTL). The CTL form reports the transportation of waste or used tires from the generator to the end-use facility.
- Electronic Data Transfer (EDT). EDT allows authorized haulers to submit CTL forms electronically using either a web-based or batch option.
- Waste Tire Management System (WTMS). This secure database collects information about waste and used tire businesses from various sources, including tire inspections.
- Training and Assistance. Comprehensive guidance manual and training materials for program participants.
- Enforcement. CalRecycle inspects and investigates waste and used tire generators, end-use facilities, and haulers to ensure that manifests are properly completed, handled, and submitted.
Waste Tire Manifest System
The Waste Tire Manifest System (WTMS) is a tracking mechanism used by CalRecycle to monitor the generation, transportation, and ultimate disposal of used/waste tires in California. The goal of the system is to help eliminate illegal storage or disposal of used/waste tires by allowing CalRecycle to focus enforcement efforts on the worst offenders.

Information from each comprehensive trip log (CTL) is key data entered and scanned as an image document into the WTMS.
WTMS automatically cross-references all waste tire pickups and deliveries to account for all waste/used tire transactions between the waste tire hauler and generators and/or end-use facilities.
Follow-Up and Enforcement Activities
CalRecycle will use the information generated by the comprehensive trip log to ensure that all waste or used tires generated and transported within California have been accounted for and delivered to permitted end-use facilities. Discrepancies will be actively enforced.
SB 876 increased the maximum civil penalties for violations of the waste tire hauling and manifesting requirements from $10,000 to $25,000 per violation per day and increased administrative penalties from $1,000 to $5,000 per violation per day.

CalRecycle provides enforcement grant funds to local enforcement agencies statewide to conduct routine inspections of waste tire generators and haulers within their jurisdictions. In addition, the California Highway Patrol (CHP) conducts routine flyovers throughout the state to detect tire piles and sets up random checkpoints at which tire hauler registration and manifests are checked for accuracy. Violators are cited under the California Vehicle Code, section 31560.

Background
The California Tire Recycling Act (established 1989) mandates CalRecycle to regulate and manage waste tires within California. SB 876 was passed in 2000 to augment the California Tire Recycling Act by further strengthening the management of used/waste tires within California. SB 876 creates major changes in how CalRecycle administers and regulates the used/waste tire industry. Some of the changes include:
- Enforcement and regulations relating to the storage of used/waste tires.
- Cleanup, abatement, or other remedial actions related to tire stockpiles.
- Research directed at promoting and developing alternatives to landfill disposal of tires.
- Market development and new technologies for used/waste tires.
- Development of a used/waste tire hauler program and manifest system.
Confidentiality of Business Information
CalRecycle recognizes the need of generators, waste and used tire haulers, and end use facility operators in maintaining confidentiality on the information generated through the waste tire manifest system. Information such as tires generated, hauled, and delivered/disposed has economic value to each party associated with the transactions. This information is not routinely made available to the public and is considered proprietary to the individual business.
CalRecycle has the authority under California Code of Regulations (CCR) Title 14, Division 7 Chapter 1, Article 4, Section 17041, et seq. to determine the trade secret, confidentiality and proprietary nature of information submitted by a person (business, corporation, etc.). CalRecycle must also comply and adhere to the Public Records Act, which allows the public to review information not claimed by the regulated community as “confidential” or determined by CalRecycle as “confidential” under the above code section.
For the purposes of the waste tire manifest system, information on the comprehensive trip log that can be claimed as confidential are the “load type” and “load amount” and the specific transaction between the generator and the hauler and the hauler and end use facility operator for that load. All other information is considered public information unless demonstrated otherwise to the satisfaction of CalRecycle.

By signing this Comprehensive Trip Log and Receipt, the signer(s) requests that the information provided on this form will be considered confidential, proprietary, and trade secret. In accordance with Title 14, CCR, section 17041 Et. Seq. if a request is made for a disclosure of this information, CalRecycle will contact the signer(s) of this form at the address and telephone number as provided on this form or receipt.
Should a third party seek public access to the load amount and load type information claimed as confidential by the generator, hauler, or end use facility, CalRecycle would contact the generator, hauler, and end use facility for the specific transaction, verify its confidentiality and then make a determination of confidentiality on the specific information sought.
