Biennial/Jurisdiction Review Status Definitions

Note: The California Department of Resources Recycling and Recovery (CalRecycle) replaced the California Integrated Waste Management Board (Board) as the department in charge of reviewing a jurisdiction’s progress in meeting the Integrated Waste Management Act requirements. Prior to Report Year 2007, the Board conducted Biennial Reviews every two years beginning with the 1996 Report Year up through Report Year 2006. As a result of the new goal measurement system for 2007 and beyond (SB 2016), the Biennial Review has been changed to a Jurisdiction Review conducted every two or four Report Years, depending on the jurisdiction’s Biennial Review Status for the 2006 Report Year. The information on this page gives the Biennial Review status code definitions for the Report Years 1995 through 2006, as well as new Jurisdiction Review status codes and definitions for Report Year 2007 and beyond.

Annual Report , Jurisdiction Review and Compliance Status Definitions For Report Year 2007 and Beyond

Annual Report Status

    • Awaiting Data/Review: Either the jurisdiction has not yet submitted their Annual Report to CalRecycle, or Local Assistance and Market Development staff has not finalized their review.
    • Staff Reviewed: The jurisdiction has submitted their Annual Report and Local Assistance and Market Development staff have reviewed the data as submitted. However, these reports have not yet been formally presented to, or approved by the Department in a Jurisdiction Review.
    • Jurisdiction Did Not Exist During This Report Year: The jurisdiction was not yet incorporated for the selected Report Year.
    • Not Subject To Review, Newly Incorporated: The jurisdiction has been recently incorporated and is not subject to review requirements for the selected Report Year.
    • Member of a Regional Agency: There is no data for this jurisdiction for the selected Report Year because the jurisdiction is a member of a Regional Agency. (See Regional Agency member jurisdictions)

Jurisdiction Review Status

    • Awaiting Review: The Department has not completed its analysis, or approved the per capita disposal figures or program implementation for the years included in this review cycle.
    • Approved: The Department has determined that a jurisdiction has implemented programs and met the diversion requirements, also stated as the 50 percent equivalent Per Capita Disposal Target.
    • Approved, Good Faith Effort (GFE): The Department has determined that a jurisdiction has made a “good faith effort” to implement its waste diversion and reduction programs to meet the diversion requirements, also stated as the 50 percent equivalent Per Capita Disposal Target.
    • Approved, Reduced Diversion Requirement: The Department has determined that a jurisdiction has implemented programs and met the diversion goal under a reduced target. The Department has reduced the 50 percent equivalent Per Capita Disposal Target for a jurisdiction because meeting the requirements is not feasible due to: small geographic size; and/or low population density of a rural jurisdiction; and/or the small quantity of solid waste generated within the jurisdiction.
    • Approved, Good Faith Effort (GFE) and Reduced Diversion Requirement: The Department has determined that a jurisdiction has made a “good faith effort” to implement its waste diversion and reduction programs to meet the diversion goal under a reduced target. The Department has reduced the 50 percent equivalent Per Capita Disposal Target for a jurisdiction because meeting the requirements is not feasible due to: small geographic size; and/or low population density of a rural jurisdiction; and/or the small quantity of solid waste generated within the jurisdiction.
    • Compliance Review: The regular Jurisdiction Review Cycle has been part of a Compliance Review for the Report Year(s) due to the issuance of a Compliance Order in a subsequent Annual Report Year.
    • No Review – Joined RA: During the course of the Jurisdiction Review cycle this jurisdiction joined a Regional Agency, therefore, no Jurisdiction Review will take place for this location as an individual reporting entity.

Compliance Status

    • Compliance Issued: The Department has issued a Compliance Order beginning with this Report Year because a jurisdiction failed to implement waste diversion programs. Once a Compliance Order has been issued, Per Capita Disposal Rates will not be posted until after the Report Year in which the Compliance Order is fulfilled.
    • Compliance Active: A Compliance Order was issued in a previous year. The jurisdiction still submits an Annual Report that is reviewed by Local Assistance and Market Development staff.
    • Compliance Fulfilled: The Department has determined that a jurisdiction under compliance has fulfilled the requirements of the Compliance Order beginning with this Report Year. After a Compliance Order has been fulfilled, the jurisdiction is returned to the standard Jurisdiction Review Cycle.
    • Penalty: The Department has imposed a monetary fine on a jurisdiction for failing to implement waste diversion programs as required by the Compliance Order. The jurisdiction is still required to fully implement diversion programs as outlined in the Compliance Order.

Biennial Review Status Definitions For Report Years 1995-2006

The Board conducted a biennial evaluation of a jurisdiction’s progress in implementing waste diversion and reduction programs to meet the requirements of 25 percent diversion in goal year 1995 and 50 percent diversion in goal year 2000 through 2006. As a result of the Board’s Biennial Review, one of several findings were issued: that the jurisdiction had implemented programs and achieved the diversion requirements; that the jurisdiction had made a “good faith effort” (see Public Resources Code Section 41850 (c)(1)(B)) toward program implementation and diversion; or they initiated a compliance process for jurisdictions failing to implement waste diversion programs and/or failing to achieve the diversion requirement.

Biennial Review status codes represent the Board’s actions when reviewing a jurisdiction’s progress during the Biennial Review. Please note that in some instances a jurisdiction may not have a diversion rate for a report year and yet may have a review status code of Board Approved or Board Accepted for the Biennial Review. In some instances, diversion rates cannot be accurately determined for a report year due to inaccurate base-year data, a Board Approved/Accepted base year that is later than the report year, or other issues.

    • Board Approved with New Base Year: The Board has determined that a jurisdiction has implemented programs and met the diversion requirements. The jurisdiction’s diversion rate is based on a new Base-Year generation study approved during the Biennial Review.
    • Board Approved Good Faith Effort: The Board has determined that the jurisdiction has made a “good faith effort” to implement its waste diversion and reduction programs to meet the diversion requirements.
    • Board Approved Good Faith Effort with New Base Year: The Board has determined that the jurisdiction has made a “good faith effort” to implement its waste diversion and reduction programs to meet the diversion requirements. The jurisdiction’s diversion rate is based on a new Base-Year generation study approved during the Biennial Review.
    • Board Accepted: The Board has evaluated a jurisdiction’s progress in meeting the diversion requirement in a non-goal year and accepted its progress.
    • Board Accepted with New Base Year: The Board has evaluated a jurisdiction’s progress in meeting the diversion requirement in a non-goal year and accepted its progress. In addition, the Board has approved a new Base-Year generation study for that year.
    • Board Approved Time Extension: The Board has granted a time extension to the jurisdiction to meet the mandated diversion requirements.
      • Begin Date: The start date the time extension went into effect.
      • End Date: The date when the time extension expires. After the end date the jurisdiction must meet the mandated diversion requirements.
    • Board Approved Alternative Diversion Requirement: The Board has granted an Alternative Diversion Rate requirement to the jurisdiction for meeting the mandated diversion requirement.
      • Begin Date: The start date the alternative diversion requirement went into effect.
      • End Date: The end date when the alternative diversion requirement expires. After the end date the jurisdiction must meet the mandated diversion requirements.
      • Alternative Diversion Rate: The Alternative Diversion Rate the Board has granted a jurisdiction.
    • Board Approved Time Extension Biennial Review Delayed: Biennial Review is delayed for the Report Year because the jurisdiction is continuing a time extension previously granted by the Board.
    • Board Approved Alternative Diversion Requirement Biennial Review Delayed: Biennial Review is delayed for the report year because the jurisdiction is continuing an alternative diversion requirement previously granted by the Board.
    • Board Approved Reduced Diversion Requirement: the Board has reduced the diversion requirement for a jurisdiction because meeting the requirements is not feasible due to the small geographic size and/or low population density of a rural jurisdiction and/or the small quantity of solid waste generated within the jurisdiction.
    • Compliance Active: The Board has initiated a compliance process because a jurisdiction failed to implement waste diversion programs and/or failed to achieve the diversion requirement. A compliance order contains a time schedule which is intended to focus the jurisdiction’s efforts on a plan of action to implement its waste diversion programs and/or achieve the diversion requirement.
    • Compliance Fulfilled: The Board has determined that a jurisdiction under compliance has fulfilled the requirements for a Compliance Order and no further action needs to be taken.
    • Board Approved, Compliance Fulfilled: The Board has determined that a jurisdiction under compliance has fulfilled the requirements for a Compliance Order. In addition, the Board has determined that the jurisdiction has implemented programs and met the diversion rate requirements.
    • Board Approved, Good Faith Effort, Compliance Fulfilled: The Board has determined that a jurisdiction under compliance has fulfilled the requirements for a Compliance Order. In addition, the Board has determined that the jurisdiction made a “good faith effort” to implement its waste diversion and reduction programs to meet the diversion rate requirements.
    • Preliminary Data Under Staff Review: The Board has not yet completed the Biennial Review of a jurisdiction. The jurisdiction’s diversion rate data is preliminary, under staff review and is subject to change. Worksheet calculation not available for editing.
