Procedures for Processing Solid Waste Facility Permits Upon Determination of No Change During Permit Review

This guidance has been developed to assist local enforcement agencies (LEAs) with updating the solid waste facility permit (SWFP) when no change is found during the 5-year permit review.

Background

Both the Public Resources Code (PRC), § 44015 and Title 27 of the California Code of Regulations (CCR) § 21675 require that all full SWFPs be reviewed and, if necessary, modified or revised from the date of last issuance, at least once every five years. These reviews are known as 5-year permit reviews and are discussed in detail on the 5-year review webpage.

This guidance describes how to process a permit to allow the LEA’s latest permit review determination of “no change” to be reflected in the text of the permit, without the added work of processing a permit application. To make this change, the first page of the SWFP should be updated with a new permit review due date and re-signed by the “approving officer.”

Enforcement Agency Processing

The following steps should be taken upon determination of “no change” during a permit review:

  • All necessary changes would be reflected on Page 1 of the SWFP and the updated cover page (PDF | Word) would be placed in front of the existing one.
  • Boxes 1-4, 6-9 and 11 remain unchanged.
  • The LEA would fill in Box 10 with the “Next Permit Review Due Date” and have the “approving officer” sign box 5.
  • The original permit issuance date in box 9 will not change.
