Paint Stewardship Permanent Regulations

Overview

The Department of Resources Recycling and Recovery (CalRecycle) is proposing permanent regulations per Public Resources Code (PRC) sections 48700 – 48707 in response to Assembly Bill (AB) 1526 (Committee on Natural Resources, Chapter 848, Statutes of 2023) and Senate Bill (SB) 1143 (Allen, Chapter 989, Statutes of 2024). Changes to the existing Architectural Paint Recovery Program regulations (Title 14, California Code of Regulations section (CCR), Article 2, sections 18950 – 18958) are necessary to clarify existing language and implement new requirements established by AB 1526 and SB 1143.

These proposed regulations would implement the statutory addition of aerosol coating products, nonindustrial coatings, and coating-related products into the Architectural Paint Recovery Program, which was renamed the Paint Product Recovery Program.

CalRecycle is proposing permanent regulations to amend Title 14, CCR, Article 2, sections 18950 – 18958.

Current Status

CalRecycle is seeking feedback from the public, the regulated community, and other interested persons on draft proposed regulatory language aimed to clarify existing language in Title 14, CCR, Article 2, sections 18950 – 18958, and to implement new requirements established by AB 1526 and SB 1143. This is a voluntary informal public comment period that CalRecycle is holding to obtain feedback from interested parties before entering the formal rulemaking phase. 

The informal public comment period for the draft proposed regulations began on June 23, 2025, and has been extended to July 24, 2025. A copy of the draft proposed regulations is available for review at the following Draft Proposed Regulatory Text link. CalRecycle invites all interested parties to submit feedback by July 24, 2025. Written feedback can be submitted via CalRecycle’s public comment portal, available on the Paint Stewardship Draft Proposed Regulations Informal Comment Period page.

Input from Interested Parties

CalRecycle encourages interested parties to provide feedback and comments pertaining to the proposed regulations. Written feedback may be submitted by July 24, 2025, through CalRecycle’s public comment portal, which can be accessed on the link Paint Stewardship Proposed Regulations Informal Comment Period.

History

On March 3, 2025, CalRecycle hosted an informal public workshop to gather feedback on proposed regulatory concepts related to AB 1526 and SB 1143, including new definitions, changes to reporting requirements, and updates to compliance and enforcement procedures. The workshop also presented CalRecycle’s planned approach to economic analysis for the rulemaking process and shared sample questions to guide data collection efforts. CalRecycle requested relevant data to help assess potential regulatory costs and provided instructions for submitting sensitive or proprietary information. A copy of the workshop materials was published at the public notice in advance of the workshop.

Paint Stewardship Program Data Requests

On August 26, 2024, CalRecycle conducted an informal workshop to solicit feedback from the public, the regulated community, and other interested persons on regulatory concepts to define new terms and modify certain plan and annual report requirements, the procedure for imposing administrative civil penalties, and existing sections that were duplicative of CalRecycle practices. A copy of the workshop materials was published at the public notice in advance of the workshop.
