Carpet EPR Enforcement

CalRecycle provides enforcement oversight of the Product Stewardship for Carpets Law. Compliance is evaluated through various means, including, but not limited to, site inspections and records review.

During an inspection, CalRecycle may ask a site to provide information and records that demonstrate compliance with the following:

Retailers, Wholesalers and Distributors

Carpet Stewardship Assessment

[PRC section 42972(c)(3)(B)]

The Carpet Stewardship Assessment must be shown as a separate line item on all invoices, receipts, or equivalent billing documents, starting with the manufacturer through the final California consumer purchase.

The Carpet Stewardship Assessment:

  • Must be clearly visible as a line item and be identified with an approved label or brief description.
  • Must be consistent with the Carpet Stewardship Plan’s developed differential assessments for the specific product sold.
  • Must not be taxed (non-taxable item).

 

Offer Compliant Carpets

[PRC section 42974(b)]

Carpet sold, offered for sale, and distributed in California must be from manufacturers in compliance with the law. To offer carpet for sale from manufacturers that do not appear on CalRecycle’s Compliant Manufacturers List can lead to penalties.

The following may be requested by CalRecycle:

  • A complete listing of manufacturers of carpet offered for sale, including carpet offered for sale on the business’ e-commerce websites.
  • Information on ‘branded’ or private labeled carpet products, including the specific manufacturers of the branded or private labeled carpet products.

Monitor CalRecycle Website

CalRecycle maintains a list of compliant carpet manufacturers and brands on its website.

Retailers that sell or distribute carpet in California are required to monitor CalRecycle’s website to determine if the sale of a manufacturer’s carpet is in compliance with the law.

Retailers need to be able to: 

  • Provide information regarding who at the business monitors CalRecycle’s website.
  • Identify the website monitored to verify accuracy.

Manufacturers

Carpet Stewardship Plan Requirement

Manufacturers (also known as ‘Carpet Mills’) that offer or sell carpet in or into California must, individually or through a carpet stewardship organization, participate in a Carpet Stewardship Plan that has been approved by CalRecycle. CalRecycle may request information and documentation supporting compliance with this requirement.
