[Archives] Designated Approved Collectors Regulations

CalRecycle maintains archived information on its website as a record of its activities by the public and CalRecycle staff.

On July 3, 2020, the Office of Administrative Law (OAL) approved regulations relative to Designated Approved Collectors. The regulations amend the Covered Electronic Waste (CEW) Recycling Program and finalize existing emergency regulations relative to Designated Approved Collectors that were adopted in 2017 and readopted in 2019. The regulations will become effective on October 1, 2020.

Description

The regulations establish and clarify:

  1. Requirements related to participating in the CEW Recycling Program as a Designated Approved Collector;
  2. Responsibilities for a California Local Government that chooses to designate an approved collector; and
  3. CalRecycle’s administrative responsibilities for the provision.

15-Day Written Comment Period

On January 31, 2020, CalRecycle initiated a 15-day written comment period for revisions to proposed regulations relative to Designated Approved Collectors. The 15-day written public comment period for this rulemaking ended on February 14, 2020.

45-Day Written Comment Period

On October 12, 2019, CalRecycle initiated a 45-day written comment period. The written comment period for this rulemaking closed on November 26, 2019.

Historical Information

Over the course of several years, program staff held multiple workshops on the topic of revising the Designated Approved Collector provision prior to the submission of the emergency regulations. Comments from the public were incorporated into those regulations.

Staff filed the emergency rulemaking package with OAL on March 9, 2017. OAL approved the Designated Approved Collectors emergency regulations on March 16, 2017. OAL readopted and approved the Designated Approved Collectors emergency regulations on March 5, 2019. The effective date of the readoption is March 17, 2019.

With respect to the proposed regulations, staff held an informal rulemaking workshop on November 15, 2017 to solicit comments on the draft proposed regulatory text. This workshop was offered both in-person and via webinar. There were no comments at the November 15, 2017, workshop.

Due to low turnout, program staff hosted a webinar on January 16, 2018, to explain and discuss the proposed regulations presented at the November workshop.
