Expanded polystyrene (EPS) Food Service Ware Notification Form

Californians can share information about EPS foam food ware still being sold in California.

The information provided on this form helps California hold producers responsible if they sell EPS plastic foam food ware in California.

It is NOT the purpose of this page to report individual Californians who use EPS foam.

This law does not prohibit individual consumers from using EPS plastic foam food ware in California.

Producers of EPS food service ware are currently restricted from selling or distributing EPS food service ware, like single-use takeout containers and cups, in or into California until they meet recycling rate requirements according to the following schedule:

Not less than 25% on and after January 1, 2025.
Not less than 30% on and after January 1, 2028.
Not less than 50% on and after January 1, 2030.
Not less than 65% on and after January 1, 2032, and annually thereafter.

Sellers of EPS food service ware that are NOT producers are not subject to this restriction.

Please note: Restaurants and retailers that do not produce their own EPS foam takeout containers:

Are not usually required to comply with this law,
But may help CalRecycle identify the producers illegally selling EPS foam.

Commonly called "Styrofoam," EPS is regulated under California's Plastic Pollution Prevention and Packaging Producer Responsibility Act.
