CalRecycle Oversight and Enforcement

Jurisdictions, non-local entities, and local education agencies were required to implement SB 1383 regulations starting on January 1, 2022. CalRecycle is responsible for evaluating compliance of those entities and enforcing the regulations in accordance with Article 15.

In cases where a jurisdiction fails to enforce or an organic waste generator is located in multiple jurisdictions, CalRecycle may also take direct enforcement action.

Jurisdiction Compliance Evaluations

For a jurisdiction compliance evaluation, CalRecycle will evaluate compliance with all jurisdiction requirements of the SB 1383 regulations.

These include, but are not limited to:

• Organic waste collection services
• Edible food recovery program
• Education and outreach
• Procurement
• CalGreen
• MWELO
• Recordkeeping
• Reporting
• Enforcement

CalRecycle will notify jurisdictions prior to conducting a compliance evaluation by contacting the jurisdictions’ designated SLCP Official and SLCP Primary contacts.

If CalRecycle determines that a jurisdiction is in violation of the SB 1383 regulations, then CalRecycle will begin the enforcement process, which could lead to the imposition of administrative civil penalties as outlined in Article 16.

During a compliance evaluation, CalRecycle will also evaluate compliance and enforce other jurisdiction solid waste program requirements. These include:

• Implementation of the source reduction and recycling element (SRRE) and household hazardous waste element (HHWE) (PRC 41821-41822 and 41825)
• Mandatory Commercial Recycling (MCR) program (14 CCR 18835-18839 and PRC 42649-42649.7)
• Mandatory Commercial Organics Recycling (MORe) program (PRC 42649.8-42649.86)

Jurisdictions Subject to Compliance Evaluations

The following jurisdictions are subject to compliance evaluations. Notification of Compliance Evaluation letters, Implementation Record Request letters, Compliance Evaluation Findings Reports, Notices of Violation (including any Notice of Violation extension letters) that have been sent to the corresponding jurisdictions are included. Notice of Violation Status will be updated based on the outcomes of the issued Notices of Violation.
