Overview
On September 29, 2025, the Office of Administrative Law (OAL) approved the Covered Electronic Waste (CEW) Recycling Fee for Video Display Devices emergency regulations. The regulations will be effective on January 1, 2026, and will expire on January 1, 2028.
The Department of Resources Recycling and Recovery (CalRecycle) proposed emergency regulations per Public Resources Code (PRC) section 42464(g), which requires CalRecycle to review the CEW recycling fee for video display devices no more frequently than annually, and no less frequently than biennially. Adjustments are made to the recycling fee if warranted to ensure that there are sufficient revenues in the Electronic Waste Recovery and Recycling Account to fund the operation and administration of the Recycling Program and all other provisions of the Electronic Waste Recycling Act of 2003 (PRC section 42460 et seq.).

Current Status
The emergency regulations were approved by OAL on September 29, 2025, and will become effective on January 1, 2026. They will expire on January 1, 2028.
The CEW Recycling Fee for Video Display Devices emergency regulations were submitted to OAL on September 19, 2025, beginning the 10-calendar day emergency rulemaking process. The 5-calendar day public comment period began on September 19, 2025, and ended on September 24, 2025.

OAL confirmed that CalRecycle received the comment before considering it. comment must have stated that it was about the emergency regulation currently under OAL review and included the topic of the emergency.
On July 15, 2025, CalRecycle presented the proposed CEW recycling fee for video display devices at the CalRecycle Monthly Public Meeting.
