Paint Stewardship Permanent Regulations

Overview

The Department of Resources Recycling and Recovery (CalRecycle) is proposing permanent regulations per Public Resources Code (PRC) sections 48700 – 48707 in response to Assembly Bill (AB) 1526 (Committee on Natural Resources, Chapter 848, Statutes of 2023) and Senate Bill (SB) 1143 (Allen, Chapter 989, Statutes of 2024). Changes to the existing Architectural Paint Recovery Program regulations (Title 14, California Code of Regulations section 18950 to 18958) are necessary to clarify existing language and implement new requirements established by AB 1526 and SB 1143.

These proposed regulations would implement the statutory addition of aerosol coating products, nonindustrial coatings, and coating-related products into the Architectural Paint Recovery Program, which was renamed the Paint Product Recovery Program.

Affected Regulatory Code Sections

CalRecycle is proposing permanent regulations to amend Title 14, California Code of Regulations (CCR), Article 2, sections 18950 -18958.

Current Status

On March 3, 2025, CalRecycle hosted an informal public workshop to solicit feedback from the public, the regulated community, and other interested persons on regulatory concepts to define new terms and modify certain plan and annual report requirements, compliance and enforcement procedures, and existing sections to align with the requirements established by AB 1526 and SB 1143. The workshop also provided an overview of CalRecycle’s approach to the economic analysis that is required for the rulemaking process and provided a sample of questions for which CalRecycle is seeking additional data and information.

The document below provides information about the types of data CalRecycle is seeking to determine the potential regulatory costs of implementing AB 1526 and SB 1143. If you have access to relevant data sources, or know others who do, please contact the Paint Stewardship Team at paint@calrecycle.ca.gov by April 11, 2025. To facilitate processing, please include “AB 1526 and SB 1143 Paint Stewardship Data Needs” in the subject line.

Please see the linked document for guidance on submitting information that may be considered confidential, proprietary, or trade secret.

Current Documents

Formal rulemaking documents will be published on this webpage once CalRecycle files a formal public notice of the proposed regulations with the Office of Administrative Law (OAL).

The workshop materials were published at the public notice in advance of the workshop.

Input from Interested Parties

CalRecycle held the hybrid public workshop on March 3, 2025, to solicit feedback from interested parties on this matter. During the informal comment period, which began on March 3, 2025, and ends on March 17, 2025, written comments may still be submitted via CalRecycle’s public comment portal, which can be accessed here: Paint Stewardship Informal Rulemaking Comment Period

Please note that under the California Public Records Act (Government Code section 7920.000 et seq.), your written and oral comments, attachments, and associated contact information (e.g., your address, phone, email, etc.) become part of the public record and can be released to the public upon request.

History

On August 26, 2024, CalRecycle conducted an informal workshop to solicit feedback from the public, the regulated community, and other interested persons on regulatory concepts to define new terms and modify certain plan and annual report requirements, the procedure for imposing administrative civil penalties, and existing sections that were duplicative of CalRecycle practices.
