CalRecycle Informal Hearing Rules Regulations

Overview

The Department of Resources Recycling and Recovery (CalRecycle) is proposing permanent regulations to implement a unified set of hearing procedures applicable to CalRecycle’s informal hearings. These standardized procedures aim to ensure consistency across all CalRecycle informal hearings.

These proposed regulations conform to the Administrative Procedure Act and aim to promote consistency, transparency, and accessibility in the informal hearing process.

CalRecycle is proposing permanent regulations to adopt Title 14, California Code of Regulations, Division 7, Chapter 1, Article 6, Sections 17063.1, 17063.2, 17063.3, 17063.4, 17063.5, 17063.6, 17063.7, 17063.8, 17063.9, 17063.10, 17063.11, 17063.12, 17063.13, 17063.14, 17063.15, 17063.16, 17063.17, 17063.18, 17063.19, 17063.20, 17063.21, 17063.22, 17063.23, 17063.24, 17063.25, 17063.26, 17063.27, 17063.28, 17063.29, 17063.30, 17063.31 and 17063.32.

CalRecycle is also proposing permanent regulations to amend Title 14, California Code of Regulations, Division 2, Chapter 5, Subchapter 2, Article 4 and Article 5, sections 2100, 2130, 2385 and 2386, Division 7, Chapter 4, Article 4, section 17974, Chapter 6, Article 8.5, sections 18458, 18464 and 18466, Chapter 8, Article 5, section 18643.0, Chapter 11, Article 3, section 18971, Article 4, sections 18975.1 and 18975.2, Chapter 12, Article 16 sections 18997.5 and 18997.6.

Current Status

The CalRecycle Informal Hearing Rules regulations were submitted to the Office of Administrative Law (OAL) on October 21, 2025, and published in the California Regulatory Register on October 31, 2025.

The public comment period will start on October 31, 2025, and end on December 17, 2025. CalRecycle will hold a hybrid public hearing on December 17, 2025. Details of how to participate and submit comments at the hearing are included below.

Input from Interested Parties

The written comment period permits any interested person, or their authorized representative, to submit written comments addressing the proposed amendments to CalRecycle. Written comments, which offer a recommendation and/or objection, or support the proposed regulations, should indicate the section to which the comment or comments are directed. CalRecycle will only consider written comments sent to CalRecycle and received during the written comment period, which begins on October 31, 2025, and ends on December 17, 2025. Written comments received by CalRecycle after the close of the public comment period are considered untimely. CalRecycle may, but is not required to, respond to untimely comments, including those raising significant environmental issues. CalRecycle will hold the hybrid public hearing starting at 9:00 am on December 17, 2025, to solicit feedback from interested parties on this matter. The public hearing will be a hybrid in-person and virtual hearing, accessible in person at:

CalRecycle headquarters
1001 I Street, Sacramento, California.

The Byron Sher Auditorium is wheelchair accessible.

The public hearing will also be accessible virtually via Zoom for direct participation and via Webcast for observation only. To attend virtually via Zoom, you must register in advance. Registration is free.

At the public hearing, any person may present statements or arguments orally or in writing, relevant to the proposed action. CalRecycle requests, but does not require, that any person who makes oral comments also submit a written copy of their testimony at the hearing. All comments in the virtual hearing will be collected and recorded.

To observe the public hearing via Webcast, please go to the Public Meeting Live Webcasts. Webcast participants will not be able to ask questions. If you are participating remotely and anticipate providing comments, it is recommended to join through Zoom. No registration is necessary to view the Webcast.

Simultaneous Spanish interpretation will be available in-person at the workshop and remotely via Zoom or webcast. For in-person interpretation services, headsets will be available and can be provided by CalRecycle staff prior to or during the workshop. If you need interpretation services in a language other than Spanish, please notify CalRecycle at Regulations@calrecycle.ca.gov by December 8, 2025, and we will do our best to accommodate your request.

Please note that under the California Public Records Act (Government Code section 7920.000 et seq.), your written and oral comments, attachments, and associated contact information (e.g., your address, phone number, email address, etc.) become part of the public record and can be released to the public upon request.

On December 11, 2024, CalRecycle conducted a workshop to solicit feedback from interested parties and to present draft proposed regulatory language.
