Overview

On August 11, 2025, the Office of Administrative Law (OAL) approved the AB 1311 Bag Drop emergency regulations. The regulations became effective on August 11, 2025.

The Department of Resources Recycling and Recovery (CalRecycle) proposed emergency regulations per Public Resources Code section 14538 in response to Assembly Bill (AB) 1311 (2021-22 Regular Session) that would specify the application content and operational standards that apply only to bag drop recycling centers.

These proposed regulations allow mobile recycling, which may include but is not limited to mobile bag drop receptacles, to be operated by recycling centers and specify the application content and operational standards that apply only to mobile recycling operated by recycling centers.

Affected Regulatory Code Sections

CalRecycle proposed emergency regulations to amend Title 14, California Code of Regulations (CCR), Division 2, Chapter 5, Sections 2000, 2045, 2060, 2500, 2505, 2525, and 2535.

CalRecycle proposed emergency regulations to adopt Title 14, CCR, Division 2, Chapter 5, Sections 2047, 2500.2, 2500.3, and 2500.5.

Current Status

The emergency regulations were approved by OAL effective August 11, 2025.

The AB 1311 Bag Drop Emergency Regulations were submitted to the Office of Administrative Law (OAL) on July 31, 2025, beginning the 10-calendar day emergency rulemaking process. The 5-calendar day public comment period began on July 31, 2025, and ended on August 5, 2025.

Interested parties had the opportunity to provide input during the public comment period, which commenced on July 31, 2025, when the emergency regulations were posted on OAL’s website. The public comment period closed on August 5, 2025.

History

On July 31, 2025, CalRecycle initiated a 5-calendar day written comment period for the proposed emergency regulations. The public comment period commenced on July 31, 2025, when the emergency regulations were posted on Office of Administrative Law’s (OAL) website. The public comment period closed on August 5, 2025.

During the public comment period, interested parties could submit comments in the following way:

Written comments were sent to OAL and CalRecycle and received before the close of the public comment period on August 5, 2025.

OAL confirmed that CalRecycle received the comment before considering it. The comment must have stated that it was about the emergency regulation currently under OAL review and included the topic of the emergency.

On December 16, 2024, CalRecycle conducted an informal workshop to solicit feedback from interested parties and to present concepts and draft regulation text that establishes requirements for the operation of bag drop recycling centers and mobile unit extensions for recycling centers.
