Recycled-Content Plastic Trash Bag Program

Overview

On September 6, 2022, the Office of Administrative Law approved the changes without regulatory effect as meeting the requirements of California Code of Regulations, title 1, section 100.

In these changes without regulatory effect, CalRecycle amended its regulation and associated forms to provide that for each pound of Recycled Plastic Postconsumer Material (RPPCM) purchased from a California source to manufacturer the plastic trash bags, or other products manufactured with RPPCM, those manufacturers will be credited with having used 1.2 pounds of RPPCM, pursuant to Public Resources Code section 42291.5. CalRecycle also amended its Plastic Trash Bag Manufacturer Certification Form CIWMB #57 and Plastic Trash Bag Wholesaler Certification Form CIWMB 58 to update its agency name and contact information.

Current Status and Documents

The Office of Administrative Law (OAL) approved the changes without regulatory effect on September 6, 2022.

Title 14, California Code of Regulations, Division 7, Chapter 4, section 17979 and Appendix A: CIWMB #57 and CIWMB 58.

History

These changes were submitted to the Office of Administrative Law (OAL) on July 25, 2022, as changes without regulatory effect under section 100 of Title 1, California Code of Regulations. OAL approved the changes on September 6, 2022.
