On June 5, 2020, the Office of Administrative Law (OAL) approved regulations governing the covered electronic waste (CEW) recovery and recycling payment rates that were approved by CalRecycle Acting Director Ken DaRosa on May 21, 2020. The regulations go into effect July 1, 2020.
These regulations are necessary to maintain CalRecycle’s responsibilities under the Electronic Waste Recycling Act of 2003, as amended. Every two years, CalRecycle is authorized and required by statute to consider the adequacy of the CEW recovery and recycling payment rates. The rates established by CalRecycle must be sufficient to cover the average net costs of compliantly collecting and recycling CEW. The regulations increase the following rates:
- Standard Statewide Recovery Payment Rate for all CEW from $0.19 per pound to $0.26 per pound
- Standard Statewide Combined Recovery and Recycling Payment Rate for cathode ray tube (CRT) CEW from $0.49 per pound to $0.66 per pound
- Non-CRT CEW from $0.60 per pound to $0.87 per pound
Affected Regulatory Code Sections
California Code of Regulations, Title 14, Division 7, Chapter 8.2, Sections 18660.24, 18660.25, 18660.33, and 18660.34.
Stakeholders had the opportunity to provide input in response to listserv notices as well as during the April 27, 2020 workshop and the May 19, 2020 monthly meeting.
