SB 1013 Addition of New Beverage Containers Permanent Regulations

Overview

The Department of Resources Recycling and Recovery (CalRecycle) is proposing permanent regulations per Public Resources Code sections 14530.5 and 14536 in response to Senate Bill (SB) 1013 (2021–22 Regular Session) that would incorporate the new beverages and beverage containers into the regulatory framework of the Beverage Container Recycling Program (BCRP) as part of the California Code of Regulations (CCR), Title 14.

Affected Regulatory Code Sections

CalRecycle is proposing permanent regulations to amend Title 14, CCR, Division 2, Chapter 5, Subchapters 1, 3, 4, 5, 6, 11.1, and 12, sections 2000, 2200, 2230, 2231, 2235, 2240, 2300, 2301, 2305, 2310, 2320, 2400, 2401, 2500, 2501, 2525, 2535, 2830, 2831, 2831.1, 2831.5, 2834, 2835, and 2900.

CalRecycle is also proposing permanent regulations to adopt Title 14, CCR, Division 2, Chapter 5, Subchapters 3 and 4, sections 2205, 2241, 2243, and 2311.

Current Status

The SB 1013 Addition of New Beverage Containers Permanent Regulations were submitted to the Office of Administrative Law (OAL) on August 5, 2025, and published in the California Regulatory Notice Register on August 15, 2025.

The public comment period will start on August 15, 2025, and end on September 30, 2025. CalRecycle will hold a hybrid public hearing on September 30, 2025. Details of how to participate and submit comments at this hearing are included below.

Input from Interested Parties

The written comment period permits any interested person, or their authorized representative, to submit written comments addressing the proposed amendments to CalRecycle. Written comments, which offer a recommendation and/or objection, or support the proposed regulations, should indicate the section to which the comment or comments are directed. CalRecycle will only consider written comments sent to CalRecycle and received during the written comment period, which begins on August 15, 2025, and ends on September 30, 2025. Written comments received by CalRecycle after the close of the public comment period are considered untimely. CalRecycle may, but is not required to, respond to untimely comments, including those raising significant environmental issues. To observe the public workshop public hearing via Webcast, please go to the Public Meeting Live Webcasts webpage. Webcast participants will not be able to provide comments through the Webcast. If you are participating remotely and anticipate providing comments, it is recommended to join through Zoom. No registration is necessary to view the Webcast.

Simultaneous Spanish interpretation will be available in person at the hearing and remotely via Zoom or Webcast. For in-person interpretation services, headsets will be available and can be provided by CalRecycle staff prior to or during the workshop. If you need interpretation services in a language other than Spanish, please notify CalRecycle at Regulations@calrecycle.ca.gov by September 22, 2025, and we will do our best to accommodate your request.

History

On December 18, 2023, CalRecycle conducted a workshop to solicit feedback from interested parties and to present concepts on draft regulations implementing the SB 1013 law to add new beverages and new containers to the California Redemption Value (CRV) program effective on January 1, 2024.
