Rulemaking History

Board staff conducted a workshop on November 7, 2003, in Sacramento, to solicit comment on informal draft regulation text. At its April 14, 2004 meeting, the Board directed staff to initiate a 45-day public comment period. A 45-day public comment period ran from November 5 through December 22, 2004.

The Board held a public hearing on the proposed regulations on January 10, 2005. After considering comments received during the 45-day comment period and comments made at the public hearing, Board staff modified the proposed regulations. Board staff was directed to initiate an additional 15-day comment period for the proposed changes to the regulations at the Permitting and Enforcement Committee meeting on March 7, 2005.

A 15-day comment period on the revised proposed regulations extended from April 7 through 5:00 p.m. on April 22, 2005.

The Board adopted the regulations at its June 14, 2005, meeting.
